Illegal Dumping Complaints Illegal, or open dumping has occurred when solid waste not generated on site has been deposited on a property. "Open dumping" means depositing solid or infectious waste into a body or stream of water, or onto the surface of the ground at a site that is not licensed as a solid waste facility. The open dumping of solid or infectious waste is a violation of the Ohio Revised Code, Section 3745.03. No person may conduct, permit, or allow open dumping. The owner of a property on which open dumping has occurred is responsible for properly disposing of solid waste from open dumping, regardless of who actually deposited the waste. The Health District has no authority to require someone other than the property owner to clean up a site where open dumping has occurred. Open dumping cases may be referred to the Ohio EPA. The Ohio EPA has the legal authority to enforce open dumping laws, and violations can result in substantial penalties. See Solid and Infectious Waste Program for more information.
