Clermont County Public Health does not require above ground swimming pools to be fenced. An in-ground swimming pool which is not fenced, is partially fenced, or has gaps in the fence four inches or larger is in violation. Gates should be latched but don't have to be locked.
A nuisance created by an unsecured swiming pool may be abated by draining the pool, or by the installation of a pool cover capable of supporting the weight of a fully grown person. An owner will need a variance from the Board of Health for a pool cover. A pool cover may require approval from the township. Check local township regulations for fencing requirements.
